  • Product Stewardship

    Product Stewardship

It goes without saying that Clariant attaches utmost importance to safety and protection of both the environment and nature in the widest sense. We regard local laws and ordinances as minimum requirements, which are binding for all companies worldwide. Anything necessary, our contribution to safety, health and environmental protection exceed these requirements. All Clariant’s products, processes and services are constantly being reviewed. With each new product or development, we make every effort to avoid waste at the source. We implement improvements to processes wherever possible. We consider it particularly important to use resources sparingly and to minimize the impact of our activity on the environment: After all, only products and processes that minimize the environmental impact have economic advantages in the long term. This ongoing process of improvement is supported by regular environmental reviews or audits.

Environmental responsibility starts during our production process. Clariant has set high targets for reducing energy, emission and waste.

    • Global Product Safety

      Global Product Safety

Global Product Strategy (GPS) was developed by the International Council of Chemical Associations (ICCA) as part of its commitment to the United Nations Strategic Approach to International Chemicals Management (SAICM) program.

The program promotes the safe use of chemical products through the entire life cycle and enhances product stewardship throughout the value chain. It will also reduce the differences in the safe handling of chemical substances between developing, emerging and industrialized countries.

The Global Product Strategy is the approach to perform risk assessments and the safe management of chemicals across geographical boundaries. Communication and transparency are important key elements for the implementation of the Global Product Strategy by the chemical industry.

So-called GPS safety summaries, a base set of information for the safe use of chemical products, will be the main tool to provide relevant and reliable information in a general, understandable language regarding the marketed chemical products to all stakeholders. Clariant is committed to the Global Product Strategy.

  • REACH

    REACH

    Outstanding global legislative expertise

Because of our outstanding global legislative expertise, we are able to provide our customers with a value-added service by ensuring full adherence to the new European REACH legislation.

The European Community Regulation on the Registration, Evaluation, Authorization and Restriction of Chemical substances (REACH) came into force on June 1, 2007. The main aims of REACH are to ensure a high level of protection for human health and the environment, to improve the communication of information on handling chemical products and to preserve and enhance the competitiveness of the chemical industry in the European Union.

For the chemical industry and its customers and suppliers, REACH represents a challenge – both inside and outside the EU – which is of strategic importance for many companies, including Clariant. Clariant has engaged intensively with REACH over the last few years and so laid the foundations for successful implementation of the new legislation. Considerable time, money and effort have already been invested, placing the company in a position where it can now finally take advantage of the huge opportunities offered by REACH.

Due to the strategic importance of REACH we have established a comprehensive REACH organization for the efficient implementation of REACH. The registration will follow in accordance with the transitional provisions of REACH. Clariant can confirm that our marketed products are in compliance with the REACH requirements.

    • REACH Timeline
      ICS_REACH_Timeline_w563x293h

      Pre-registration

Manufacturers and importers had to pre-register substances that were already on the EU market (so-called phase-in substances), if they wanted to benefit from transitional arrangements that allowed registering them at a later stage. Pre-registration also enabled registrants to share data with other registrants and to avoid carrying out redundant tests.

The pre-registration period was limited from 1 June 2008 to 1 December 2008.

      Registration

REACH requires manufacturers and importers of chemical substances (larger than or equal to 1 tonne/year) to obtain information on the physicochemical, health and environmental properties of their substances and use it to determine how these substances can be used safely. Each manufacturer and importer must submit a registration dossier documenting the data and assessments to the Agency.

The registration numbers of already registered substances will be noted on the according Safety Data Sheet as soon as available. In case of mixtures only the registration number of hazardous component will be listed.

    • REACH Dialog System

      REACH Dialog System

To ensure the important communication in the Supply Chain we foster a close dialog with our customers by using Clariant’s REACH Dialog System (RDS).

The RDS is a state-of-the-art web based REACH portal which is accessible 24h/7days. The portal brings the REACH experts at Clariant and at the customer company together and offers to our customers a maximum of transparency on the use and exposure communication process.

By invitation and login, our customers enter the RDS system using a secured link They find an overview of active purchased products which have to be registered within 2010 and therefore can easily identify if a product is a substance, polymer or mixture and contains products which are REACH relevant or classified as hazardous good.

For each REACH relevant product, the customer gets a list of identified uses which Clariant intends to defend and he may insert further uses or attach exposure scenarios. Clariant evaluates the data and will inform which uses will be supported in the dossiers that are submitted to ECHA. The feedback from ECHA about the accepted uses will afterwards be included in the RDS.

To apply for access to the RDS system please contact REACH@clariant.com

      • Where do I find useful Reach Information

Where can I find useful REACH information?

REACH and CLP guidance from the European Chemical Agency (ECHA): http://guidance.echa.europa.eu/
FAQ catalogue from the European Chemical Agency (ECHA): http://echa.europa.eu/reach/faq_en.asp
Cefic’s guidance documents and tools: http://cefic.org/templates/shwPublications.asp?HID=750
      • Does Clariant prepare exposure scenarios for transported isolated intermediates?

Does Clariant prepare exposure scenarios for transported isolated intermediates?

No, for substances which are only used as transported isolated intermediates under strictly controlled conditions, means a substance that is
manufactured for and consumed in or used for chemical processing in order to be transformed into another substance, exposure scenarios
are not required according the REACH regulation.
      • Does Clariant submit the chemical safety report to customers?

Does Clariant submit the chemical safety report to customers?

No, because we transfer the essential information from the chemical safety report into the extended safety data sheet, which we deliver to
        our customers.
      • Are all uses of a dangerous substance always supported by the supplier?

Are all uses of a dangerous substance always supported by the supplier?

No, the use of a dangerous substance on its own or in preparations must be in accordance with the exposure scenario delivered by the supplier as an annex of the Safety Data Sheet. If a certain use is not identified in the registration dossier, by the downstream user (DU) latest 12 month after receiving the registration number in a respective DU-Chemical Safety Report or with a spontaneous update of the dossier by the registrant, the product cannot be used for that purpose.
      • What if a downstream user has identified a new use or a use not covered by the registration?

What if a downstream user has identified a new use or a use not covered by the registration?

There are three possible scenarios for a downstream user to register a new use (including respective conditions of use) or previously
        unregistered use:

        1. Clariant registers the new use, in which case the downstream user needs only to supply the necessary exposure information to
        Clariant.

        2. The downstream user does not wish to inform Clariant of a certain use. In this case, the downstream user should carry out its own
risk assessment and register the particular use with the European Chemical Agency directly.

        3. Clariant does not support a specific use for its product. In this case, the downstream user should consider carrying out a risk
assessment and register the particular use with the European Chemical Agency.

      • Must I inform the supplier when I have new information related to the use of a dangerous substance?

Must I inform the supplier when I have new information related to the use of a dangerous substance?

Yes, the downstream user must inform the supplier irrespective of the actual use if any new information related to the dangerous properties
of the product become apparent, or when any recommended risk management measures for the defined use are not sufficient.
      • Would Clariant act as Only Representative for Non-EU-Not Clariant companies?

Would Clariant act as Only Representative for Non-EU-Not Clariant companies?

Clariant will not act as “Only Representative” (OR) for Non-EU-Not Clariant companies (e.g. Manufacturer, Importer, Trader, Agent,
        Distributor, Sourcing Centre).
      • Does Clariant reveal pre-registration numbers?

        Does Clariant reveal pre-registration numbers?

Clariant does not reveal the pre-registration number of their substances. The pre-registration number is confirming to the pre-registrant that
the pre-registration has been submitted successfully to ECHA. There is no legal requirement to communicate the pre-registration number in
        the supply chain.
      • Where are Substance of Very High Concerns (SVHC) in Clariant products mentioned?

Where are Substances of Very High Concern (SVHC) in Clariant products mentioned?

If any substance categorized under REACH as a Substance of Very High Concern (SVHC), thus classified as CMR, PBT or vPvB and filed in the substance list of Annex XIV or in the related candidate list, is an ingredient (> 0.1% w/w) in our products, it is mentioned in chapter 3 of the corresponding EU Safety Data Sheet and there is an additional SVHC note in chapter 15.

Any change will be communicated immediately to our current customers via update of the Safety Data Sheet.

      • How is Clariant providing registration numbers of already registered substances?

How is Clariant providing registration numbers of already registered substances?

The registration numbers of already registered substances will be noted on the according Safety Data Sheet as soon as available. In case of mixtures only the registration number of hazardous component will be listed.
      • Will Clariant reveal compositions of products?

Will Clariant reveal compositions of products?

Clariant classifies and labels their products according to the EU Regulation on classification, labelling & packaging (CLP Regulation 1272/2008) as well as being in compliance with any local market hazard communication regulations. For business reasons we do not reveal more detailed composition information than is required by law.
      • Are exported products from Clariant in compliance with REACH?

Are exported products from Clariant in compliance with REACH?

Yes, we have pre-registered and will respectively register substances on their own or in Clariant products according to the

transitional provisions of the REACH regulation. That means that any exported substances and products from Clariant EU affiliates to non-EU- countries are compliant with the REACH regulation. Nevertheless, according obligations for re-importing of the respective substances must be taken into account.

      • What is considered as Re-Import of Clariant Products?

Nevertheless, according obligations for re-importing of the respective substances must be taken into account.
      • Does Clariant confirm Re-import of Clariant products?

Does Clariant confirm Re-import of Clariant products?

No, because proof of re-import of Clariant products in the same supply chain is the responsibility of the companies that use our products. Clariant cannot guarantee the use of Clariant products in the supply chain of downstream user’s products.
      • How does Clariant support re-import of Clariant products?

How does Clariant support re-import of Clariant products?

ECHA requires in general pre-registration of Re-Imports. Clariant may provide the composition of the substances subject to re-import to allow the customer to late pre-register the corresponding substances. For confidentiality reasons Clariant will provide a random list of substances that will include the substances which are subject to pre-registration for late pre-registration by the customer. Please note: Once a substance is registered by Clariant its re-import is legally compliant.
